§ 3-21-1.
Stalking.
Any person who willfully, maliciously, and
repeatedly follows or harasses another person or who makes a credible threat to
another person with the intent to place that person in reasonable fear of death
or serious bodily injury is guilty of a Class A misdemeanor.
§ 3-21-2.
Definitions.
The following
definitions shall apply to this Chapter:
1. "Harass" means a knowing and
willful course of conduct directed at a specific person which seriously alarms,
annoys, or harasses the person, and which serves no legitimate
purpose.
2. "Course of conduct" means a
pattern of conduct over a period of time, however short, evidencing a continuity
of purpose.
3. "Credible
threat" means a threat made with the intent and apparent ability to carry out
the threat. The threat need not be verbal.
§ 3-21-3.
Order of Protection.
Upon the
filing of a complaint under this Chapter, the victim shall immediately be issued
an Order of Protection from the actor named in the complaint.
